Di\u011fer taraftan, bu konuda da\u011f\u0131n\u0131k olarak bir\u00e7ok koruyucu ve cezai d\u00fczenleme son y\u0131llarda yap\u0131lm\u0131\u015ft\u0131r ve yap\u0131lmaya devam edilecektir.<\/p>\n<p>T\u00fcrkiye\u2019de halen y\u00fcr\u00fcrl\u00fckte olan ve tasar\u0131 halindeki kanun ve y\u00f6netmeliklerle ilgili olarak\u00a0<strong>Av. Emre Berk<\/strong>\u00a0taraf\u0131ndan haz\u0131rlanan ve\u00a0<strong>Do\u011frudan Pazarlama \u0130leti\u015fimcileri Derne\u011fi<\/strong>\u2018nin web sitesinde yer alan detayl\u0131 bir \u00e7al\u0131\u015fmaya\u00a0<a href=\"\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #d52300;\">buray\u0131 t\u0131klayarak<\/span><\/a>\u00a0ula\u015fabilirsiniz.<\/p>\n<p>Ancak, \u00f6zellikle bug\u00fcne kadar yap\u0131lm\u0131\u015f olan d\u00fczenlemelerle ilgili \u201cgerek\u00e7e\u201dlere bak\u0131ld\u0131\u011f\u0131nda, kanun koyucunun bir\u00e7ok kanaldaki \u201c<strong>\u0130zinli Pazarlama<\/strong>\u201d kavramlar\u0131na y\u00f6nelik tek bir d\u00fczenleme yapmaktansa, ilgili t\u00fcm kanunlar\u0131n i\u00e7ine bu d\u00fczenlemeleri ayr\u0131 ayr\u0131 ekleme e\u011filiminde oldu\u011fu g\u00f6zlemlenmektedir.<\/p>\n<p>Kanun koyucunun bu yakla\u015f\u0131m\u0131 ise hem mevzuatta b\u00fct\u00fcnl\u00fc\u011f\u00fcn ve tutarl\u0131l\u0131\u011f\u0131n sa\u011flanmas\u0131 a\u00e7\u0131s\u0131ndan, hem de T\u00fcrkiye\u2019de ileti\u015fim sekt\u00f6r\u00fcn\u00fcn sa\u011fl\u0131kl\u0131 geli\u015fimi ad\u0131na baz\u0131 riskler te\u015fkil etmektedir. \u00d6zellikle hali haz\u0131rda y\u00fcr\u00fcrl\u00fckte olan baz\u0131 kanun ve y\u00f6netmeliklerle, yeni yap\u0131lacak olanlar aras\u0131ndaki tan\u0131m ve yapt\u0131r\u0131m karma\u015falar\u0131 olu\u015fmas\u0131 en b\u00fcy\u00fck risk olarak g\u00f6r\u00fcnmektedir. Do\u011fal olarak bu durum, eksik veya yanl\u0131\u015f\/farkl\u0131 yorumlanmaya a\u00e7\u0131k bir\u00e7ok konu ortaya \u00e7\u0131kmas\u0131n\u0131 da kolayla\u015ft\u0131racak ve her d\u00fczenlemede benzer risklerle kar\u015f\u0131 kar\u015f\u0131ya olunmas\u0131n\u0131 ka\u00e7\u0131n\u0131lmaz hale getirecektir.<\/p>\n<p>\u0130zinli pazarlamay\u0131 sekt\u00f6r\u00fcn t\u00fcm sa\u011fduyulu kurumlar\u0131 (markalar ve servis sa\u011flay\u0131c\u0131lar) savunurken b\u00f6yle bir riskin ger\u00e7ekle\u015fmesi ve t\u00fcketici-marka eksenindeki ileti\u015fime zarar verici uygulamalar ortaya \u00e7\u0131kmas\u0131 durumunda ise t\u00fcm d\u00fcnya i\u00e7in bu \u00e7ok yeni alanda, T\u00fcrkiye\u2019nin uluslararas\u0131 rekabetin gerisinde kalmas\u0131 s\u00f6z konusu olacakt\u0131r. Dijital ileti\u015fim sekt\u00f6r\u00fc t\u00fcm d\u00fcnyada oldu\u011fu gibi T\u00fcrkiye\u2019de de y\u00fcksek h\u0131zda b\u00fcy\u00fcyen bir yap\u0131ya sahiptir.
